Medical Malpractice Is Common

Many people believe that medical malpractice is rare, but recent research suggests it is more common than we would like to believe. According to a 2010 study by the Department of Health and Human Services, as many as 1 in 7 (13.5%) of Medicare patients experience an adverse event during a hospital stay, and 1.5% of patients suffered died at least in part due to an adverse event. A full 44% of these events are caused by doctor’s errors.

Why Don’t Doctors Work Harder to Stop Medical Malpractice?

We know that medical errors are often preventable. Several ground-breaking studies have shown how hospitals can dramatically reduce their error rate and virtually eliminate the need for medical malpractice lawsuits. But other hospitals aren’t following suit, and the cost is staggering: a 2012 study by the Institute of Medicine showed that if all hospitals just followed the known best practices, they could save 75,000 lives a year.

But doctors and hospitals don’t work hard to punish doctors who cause errors. According to a 2007 study by Public Citizen, just 5.9% of doctors are responsible for 58% of all medical malpractice payouts, and just 1.1% of doctors are responsible for 20% of all payouts. Worse, these doctors aren’t disciplined by their peers. Only 15% of doctors with 4 or more payouts are disciplined by their medical boards, and only 33% of doctors with 10 or more payouts are disciplined. Two-thirds of doctors responsible for ten or more patient injuries are never punished by their medical boards.

Why don’t hospitals follow best practices? Why aren’t dangerous doctors disciplined? Perhaps the answer comes from a 2013 study published in the Journal of the American Medical Association showing that hospitals make more money when complications occur.
